Terms and Conditions of Sale and Use

1. Purpose

 

These Terms and Conditions of Sale and Use (hereinafter the “Terms”) are intended to define the conditions governing access to, use of, and purchase of the products and services offered on the Spatiora website.

 

Any use of the website or any order placed implies full and unconditional acceptance of these Terms.

 

2. Nature of Products and Services – Digital Goods

 

Spatiora exclusively offers:

  • digital content, including premium articles, analyses, reports, downloadable documents or content accessible online;

  • remote intangible services, including consulting, strategic support and intellectual services.

DIGITAL GOODS – NO SHIPPING

 

No physical products are sold or shipped. No postal delivery, carrier, tracking number or shipping fees apply.

 

3. Access to the Website and Services

 

Access to the website is free. Certain content or services are reserved for users who have created an account and/or completed a payment.

Activation of access following payment constitutes full delivery of the service or digital content.

 

4. Orders and Payment

 

Payments are made online through the secure payment providers Stripe and PayPal.

 

Any order shall only be considered final once payment has been effectively confirmed.

 

Spatiora reserves the right to suspend or refuse an order in the event of suspected fraud or payment incident.

 

5. Delivery of Digital Content

 

Digital content is deemed delivered as soon as:

  • access is activated on the user account;

  • a download link is made available;

  • an access email is sent to the address provided when placing the order.

Such availability constitutes valid proof of delivery under Stripe and PayPal rules.

 

Unless otherwise stated, delivery is immediate after payment confirmation, subject to a maximum technical delay of 24 hours.

 

6. Subscriptions and Recurring Access

 

Certain services are offered as monthly or annual subscriptions:

  • the subscription is activated upon validation of the first payment;

  • payments are automatically renewed according to the selected billing cycle;

  • each payment corresponds to the continuous provision of the service and is deemed delivered.

Failure to use the service during a subscription period shall not constitute a failure to deliver nor grounds for a refund.

 

7. Services

 

Consulting or support services are deemed delivered as soon as:

  • the meeting has taken place;

  • the digital deliverables have been transmitted;

  • access to the service has been made available.

Any written or technical evidence may be used to demonstrate proper performance.

 

8. Right of Withdrawal

 

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to:

  • digital content supplied immediately after payment;

  • services fully performed before the end of the withdrawal period.

By validating the order, the customer expressly agrees to immediate performance and waives their right of withdrawal.

 

9. User Responsibility

 

The user is responsible for:

  • the information they provide;

  • their equipment and internet connection;

  • the proper use of the content.

No dispute may be based on the absence of physical delivery, personal technical incompatibility or non-use of the service.

 

10. Proof of Delivery and Abuse Prevention

 

Spatiora reserves the right to retain and provide logs, timestamps, access histories and proof of transmission, particularly in the event of a dispute or chargeback.

 

11. Intellectual Property

 

All website content is protected by intellectual property law. Any unauthorized reproduction or distribution is prohibited.

 

12. Personal Data

 

The processing of personal data is governed by the Privacy Policy available on the website.

 

13. Governing Law and Jurisdiction

 

These Terms are governed by French law. In the event of a dispute, the competent courts shall be those having jurisdiction over the registered office of the publisher, unless otherwise provided by mandatory legal provisions.
